Opinion from the CT Appellate Court

Argued October 20, 2008—officially released March 31, 2009

The Connecticut Appellate Court issued an opinion in his appeal saying that Judge Fuger was wrong in dismissing our claims of the suppression of exculpatory evidence and Vogt's & criminal trial counsel's ineffective assistance of counsel [failure to present an arson expert & failure to employ available evidence]. The case is being sent back to the trial court for a continuation of the trial but with a finding by the Appellate Court that we have established a prima facie case that the State suppressed exculpatory evidence and that there was ineffective assistance of counsel.
